ANALYSIS OF LEGISLATIVE ACTS ON TOBACCO CONTROL IN THE SUBJECTS OF THE RUSSIAN FEDERATION

Summary:
The adoption of the WHO Framework Convention on Tobacco Control (FCTC) was a counteraction to the spread of the tobacco epidemic worldwide. One of the conditions for achieving the FCTC is the implementation of tobacco control measures, taking into account the socio-economic, national and geographical characteristics of the regions.
Purpose. Analysis of legal acts on tobacco control adopted in the subjects of the Russian Federation in the period after the adoption of Federal Law No. 15 dated 02/23/2013 "On Protecting the health of citizens from ambient tobacco smoke, the consequences of tobacco consumption or consumption of nicotine-containing products" (FZ No. 15-FZ).
Materials and methods. The search for legal acts of the subjects of the Russian Federation in the field of tobacco control was carried out in the database of the ConsultantPlus (the legal reference system) for the period of 2013-2023. The level of implementation of existing legal acts was assessed using a survey of regional experts. For this purpose, the questionnaire of the expert survey "Assessment of the effectiveness of legislative measures on tobacco control" was developed. The specialists determined by the executive authority in the field of health protection of citizens of the subjects of the Russian Federation were involved in the expert group. A total of 402 experts from 79 regions took part in the survey.
Results. Legal acts aimed at tobacco control were adopted in 69.4% of the subjects of the Russian Federation in the period from 2013 to 2023. Currently, 110 legal acts are in force in the subjects of the Russian Federation. Orders on banning tobacco smoking in the premises and territories of medical organizations, on the organization of informing and advising patients about the dangers of tobacco consumption were issued in 21.2% of the subjects of the Russian Federation. Orders on the organization of prevention and medical care when quitting tobacco and nicotine were issued in 20.0% of the subjects of the Russian Federation. Additional measures were taken in 41.1%.
Conclusion. In the period from 2013 to 2023, 2/3 of the subjects of the Russian Federation adopted regional legal acts aimed at implementing the norms of Federal Law No. 15-FZ. The lowest level of implementation was noted in relation to the organization of prevention and medical care for tobacco and nicotine withdrawal. Only 1/5 of the subjects have adopted relevant legal acts. As the most effective measure that will further reduce the prevalence of tobacco and nicotine-containing products in the country, experts noted increased control over the implementation of the norms of Federal Law No. 15-FZ.
